CHAZAK’s TERMS & CONDITIONS
You must read these carefully before signing up for an overseas programme.
DEFINITIONS:

‘ACTUAL COST’ – The cost of a programme to Chazak

‘CHAZAK’ – Chazak, whose registered office is at 379 Hendon Way, London, NW3 3LP (Company No. 1142937. Charity No. 07485527).

‘APPLICANT’ or ‘PARTICIPANT’ – The person named on the programme application. For Applicants under 18 the Applicant’s parents/guardians will be known hereafter as the Applicant/Participant.

‘BOOKING FEE’ – A non-refundable payment to secure a place on the Chazak Programme.
-
‘DIRECTOR’ – The Rabbi running the programme.
-
‘PROGRAMME COST’ – The cost of a programme to an Applicant/Participant.
-
‘FINAL PAYMENT’ – The balance of the Programme Cost and the Booking Fee.
-
‘FREE TIME’ – The period of discretionary time before or after the compulsory activities on the programme.
INTERPRETATION:
-
Words denoting the singular number only shall include the plural and vice versa. Words denoting any gender include all genders and words denoting persons shall include firms and corporations and vice versa.

Unless the context otherwise requires reference to any clause or sub-clause is to a clause or sub-clause (as the case may be) of or to this document.

The headings in this document are inserted for convenience only and shall not affect the construction or interpretation of this document.
TERMS:

APPLICATION
-
Application Booking: To secure a place on the Chazak programme, the Applicant must apply online at www.chazak.org.uk and fill in the application form. This will be emailed to a Trips Advisor who will call you for payment.

Under 18s: If the Applicant is under 18, his parents may be telephoned by a Trips Advisor after the Applicant’s appointment to discuss the programme and pricing.

Late Booking: Applicants who apply and are accepted on a programme less than eight weeks before the programme’s departure date are required to pay the whole of the Programme Cost at the time of the booking.

Correspondence: The Applicant is responsible for providing his correct contact details (including home and mobile numbers, address, email addresses) on his application form and he is required to notify Chazak in writing if these change from the information provided on the application form. Chazak will not be held responsible if a Participant does not receive any correspondence due to incorrect or out of date information.

BURSARIES
-
Scholarship: The Participant may be given a scholarship to enable him to participate in a programme and will be expected to adhere to a high level of responsibility and commitment and attend all aspects of the scheduled programme with all absences to be cleared by a member of staff beforehand. If the Participant fails to adhere to these conditions he will automatically forfeit the Chazak scholarship and will be bound to pay Chazak the difference between the Actual Cost and the Programme Cost. This sum is payable within fourteen days of the date that the Participant returns home from the programme.

Financial Assistance: This may be available for those who are unable to cover the Programme Cost. In cases of financial difficulties for under 18s there are further limited bursaries available. Chazak retains the right to offer further bursaries at its own discretion and if the Applicant requires further bursaries he must contact the Chazak office on 020 8457 2120.

PAYMENTS
-
The Booking Fee, which is not refundable under any circumstances (except in accordance with Clause 4.3 below), must be paid in full to secure the place.

The Final Payment must be paid in full by at least a week before departure and by one of the following methods:
-
Cash;
-
Cheque payable to Chazak with name of Participant and programme on the back of the cheque;
-
Credit card; or
-
Bank transfer to a/c no: 12703613, sort code 60-10-34, NatWest, Hendon Central Circus, 5 Central Circus, London, NW4 3LE, use the trip name and Participant name as a ref number.

Late payment will incur administration charges at Chazak’s discretion and may result in cancellation of the Applicant’s place on the programme. Details of the cancellation costs will apply as set out in Clause 8 below.

IMPORTANT DOCUMENTATION
-
Forms: The Applicant must deliver to Chazak no later than eight weeks before departure, one passport photograph or a passport style photo, the Final Payment, all waiver forms duly completed and signed (if applicable), the scholarship form (if applicable) and a completed medical form signed by his doctor (if applicable).

Medical Disclosure: The Applicant must detail on his medical form any pre-existing physical or mental health illnesses or conditions. The Applicants must also inform Chazak of any changes in his health from the date of the application until the date on which the programme departs.

Application Refusal: Chazak’s medical advisor may need to consult the Applicant about any medical issues or concerns and Chazak reserves the right to refuse an application if, in its opinion, the Applicant is unsuitable. Chazak’s decision in this regard is final, however in these circumstances; the Booking Fee will be refunded in full.

Insurance: The Participant must purchase full comprehensive travel insurance including personal accident, medical treatment and repatriation. It must cover the Participant for the whole length of the programme inclusive of flights. The policy details including the name of the insurer and policy number must be clearly written on the medical form.

Additional Costs: Chazak are not and will not be responsible for any additional costs incurred by the Participant including but not limited to personal equipment, medical checks or medicines.

Next of Kin: The Participant is required to provide details of an appropriate next of kin. Chazak reserves the right at all times to speak to the Participant’s next of kin without the express permission of the Participant.

Emergency Contacts: The contacts listed on the Participant’s medical form must be contactable for the full duration of the programme.

Failure to comply with this Clause 4 may result in cancellation of Applicant’s place on the programme and cancellation charges will apply as set out in Clause 8 below.

THE PROGRAMME
-
The programme dates are subject to change at short notice and Chazak will not be held liable or responsible for any changes and no refunds will be given as a result of any unscheduled changes.

The programme includes, accommodation, meals, transportation, activities and education during programme time however the cost does not include flights, spending money or any costs incurred by the Participant during Free Time.

The accommodation will vary in each destination but will be of good standard. Room sharing will apply and the Applicant will be able to indicate with whom he would like to share on his medical form. All requests for room allocations will be considered but Chazak does not guarantee the final allocation.

If the number of participants on the programme is too large then Chazak reserve the right to split the trip into multiple groups. In these circumstances and where a Participant has indicated a room sharing preference as per Clause 6.3 above, Chazak will endeavour to place participants in the same group, but does not guarantee the final allocation.

The Participant will be responsible for ensuring that he leaves each hotel room in the same condition he found it and he will be liable for any breakages or damage he causes.

Information about health matters including but not limited to vaccinations, malaria tablets, clothing, equipment and climate are given in good faith and Chazak does not accept responsibility for the validity of such advice. Participants are advised to make their own checks before departure.

The Participant takes full responsibility for their own personal belongings at all times and Chazak takes no responsibility for lost, stolen or broken items. Chazak will not bring any unclaimed items back to the UK at the end of the Programme.

Itineraries: For security reasons only a basic outline of the itinerary will be given to the Participant prior to departure, with the full itinerary is to follow at the start of the programme. The Participant hereby accepts that the itinerary as a whole or any part thereof is subject to change without notice to the Participant. Chazak will not be held liable or responsible for any delays or modifications to the scheduled itinerary and no refunds will be given as a result of any unscheduled changes.

Joining the Programme: The Participant is responsible for joining the programme at the correct time and in the correct place (this includes if the Participant intends to join the programme abroad) and is responsible for his own transportation arrangements to the airport.

Participant Release: When a Participant knows of an occasion or event taking place during the programme for which he is required to attend he must submit a request to be released in writing and emailed to info@chazak.org.uk. All releases are at Chazak’s discretion and only the Programme Director has the authority to give such consent. If consent is granted, the Applicant must complete a Participant Release Form. No requests will be processed unless the Final Payment has been received. Any additional costs incurred as a result of or occasioned by the release must be paid for by the Participant.

Activities: The Participant shall participate in the programme’s activities at his own risk.

Free Time: Chazak will take full responsibility for the Participants during the programme except during the Free Time when the Participant will be expected to be responsible for his own welfare.

Behaviour: The Participant hereby agrees to abide by the instructions of the Programme’s Director and Chazak staff. Any illegal act or inappropriate behaviour by the Participant that in the opinion of the programme staff is detrimental to the safety and welfare of the programme and others may result in the Participant being asked to leave the programme, without the right to a refund. If the Participant is removed from the programme, he will be required to travel home at his own expense and no refunds will be given. In addition, he will be required to pay to Chazak the difference between the Actual Cost and the Programme Cost. This sum is payable with fourteen days of the date that the Participant returns home from the programme.

Illegal Drugs and Alcohol:

The possession, use or distribution of drugs for non-medical purposes whilst on a programme is strictly forbidden. Chazak reserves the right to search the Participant or any of his property at any time if there are reasonable grounds to believe that the prohibition on substances is being or has been infringed. If the Participant refuses to comply with these search procedures, or if there is sufficient suspicion that the prohibition has been infringed, he will be removed from the programme immediately. Chazak reserves the right to inform the police of any suspicions it may have with regard to the use of illegal substances by the Participant.

The possession, use or distribution of alcohol whilst on a programme if the Participant is under 18 is strictly forbidden. If Chazak reasonably believe that the prohibition on alcohol has been infringed, then the Participant will be immediately removed from the programme.

If the Participant is over 18 but is deemed to have drunk excessive amounts of alcohol, Chazak has discretion as to whether or not he be removed from the programme.
If the Participant is removed from the programme for the reasons stated in this Clause 6, he will be expected to travel home at his own expense and no refunds will be given. In addition, he will be required to pay to Chazak the difference between the Actual Cost and the Programme Cost. This sum is payable with fourteen days of the date that the Participant returns home from the programme. In this instance, participants will escorted to the Airport, if they refuse then Chazak will notify the parents who will then take back responsibility of them and have to fly in to pick up their child.

CANCELLATION OF THE PROGRAMME
Chazak reserves the right to cancel the programme at any time prior to its departure without prior notice. In the event of cancellation, the Participant will either be offered an alternative programme or a full refund. Chazak will not be liable for any other associated losses arising out of the cancellation.

CANCELLATION BY APPLICANT
If the Applicant wishes to withdraw from a programme for any reason, he must inform Chazak in writing immediately. The cancellation will take effect from the date the written notification is received and the following cancellation charges will apply.

In addition to the cancellation charge, where flight tickets have already been booked and paid for, the Applicant may be liable for the additional cost of the ticket less the relevant cancellation charge.

GENERAL INFORMATION

Criminal Records Bureau (‘CRB’) checks in accordance with UK law, Chazak conducts CRB checks on all staff.

Complaints Procedure: Any complaints about the programme should be made known to the Director running the programme at the first instance. If the Participant is not satisfied with how the complaint was dealt with he is advised to submit a further complaint in writing to Chazak within 28 days of the end date of the programme.

Photographic rights: Photographs and video footage will be taken during the programme for use in future promotional material for Chazak and associated organisations. The Participant hereby consents to the use any of any material containing pictures or footage of him by Chazak and acknowledges that Chazak hold all associated photographic and other rights over this material.

Data protection:

The Participant acknowledges that Chazak will hold personal data relating to his physical and mental health and hereby consents to the release of such information where appropriate to medical advisers and persons involved in the operation of programmes or others as appropriate.

Chazak will on occasion pass a Participant’s details to carefully selected Third Party Organisations.

The programme promotes group travel and the Participant’s details will be passed on to other participants travelling at the same time as the Participant at the end of the programme. If the Participant would prefer to withhold this information, he is required to indicate this on the application form.

Facebook: If the Participant fails to provide photographs 1 week before the programme starts Chazak will try to obtain them from Facebook or other networking sites.

CONSENT
On signing up to a programme the Participant agrees to accept and be bound by these terms and conditions and all other documents referred to. Any false statement or material omissions in the information provided by the Participant in any form will entitle Chazak to cancel the Participant’s application or end their participation and in such circumstances, the Participant will have no right to a refund.

LIABILITY EXEMPTION
Chazak shall not be liable to the Participant in contract, tort, negligence, breach of statutory duty or otherwise for any loss, damage, costs or expenses of any nature whatsoever incurred or suffered by the Participant of an indirect or consequential nature including without limitation any economic loss or other loss of turnover, profits, business or goodwill.

CONFIDENTIALITY
It is agreed between Chazak and the Participant that the terms of this agreement and any associated document(s) will remain confidential between the parties. Save as is required by law. For the avoidance of doubt this prevents the Participant from discussing or disclosing the terms of this Agreement to any newspaper or similar publication.

NO IMPLIED TERMS
The Participant acknowledges that, in agreeing to these terms and conditions, he does not do so in reliance on any representation, warranty or other provision except as expressly provided in this document, and any conditions, warranties or other terms implied by statute or common law are excluded from this document to the fullest extent permitted by law.

FORCE MAJEURE
Chazak shall not be liable for any failure or delay in performance of these terms, which is caused by circumstances beyond its reasonable control.

NOTICES
Any notice or written request required to be given under these terms and conditions shall be sent by first class post to Chazak at 379 Hendon Way, London, NW4 3LP.

SEVERANCE
If any term or provision in this document shall in whole or in part be held to any extent to be illegal or unenforceable under any enactment or rule of law that term or provision or part shall to that extent be deemed not to form part of this document and the enforceability of the remainder of this document shall not be affected.

GOVERNING LAW
These conditions shall be governed by and construed in accordance with the laws of England and Wales and each party agrees to submit to the exclusive jurisdiction of the courts of England and Wales.
